Limited Liability

 

Aqua Xtreme warrants that our products are free of from defects in materials and workmanship for a period of one year from the date of manufacture. Products that prove to be defective under the use of normal use and proper use during the warrantee period because of defective workmanship or faulty material will be replaced or repaired without charge. Aqua Xtreme shall inspect all warranty claims and in the event of a defect, repair or replace the defective part or entire item at its option. The purchaser must, before a return of a defective product, obtain a authorization number and return address. Please contact info@aqua-xtreme.com . Once authorization has been given, the purchaser must ship the product, prepaid to Aqua Xtreme for repair.

All claims should be made within 14 days of purchase/receipt.

Should any refunds be given on goods/products/services they will be given exclusive of shipping and a restocking fee of 25% of the invoice value. There are no refunds on products sold on discounted goods, discontinued and closeouts.

Any deposits paid for products goods/services that require manufacturing is non refundble.

 

This warranty does not cover:

 

The warranty is non transferable and belongs to the registered purchaser only. If the product is resold the warranty is void and does not apply to owner modifications.

Damage while shipping, in storage or handling by any third party. Insurance of the products at all times is the responsibility of the purchaser.

The warranty will cover only the product purchased and not products that are supplied free of charge or part of the package,

Claims must be made prior to any  use of all products. On receipt of the product/goods it shoud be checked and tested. Once the goods are used it is deemed that the goods are in perfect condition, all claims therefore are based on normal wear and tear usage of the products.

Products used for rental, for hire or in professionally guided tours, commercial, competition/races and the training for competition/races or military and other uses are not normal recreational purposes; punctures, cuts and abrasions sustained in normal use ; and items in accidents; and items damaged in white water,  and other unreasonable uses or improper storage.

The warranty also does not cover towing, exposure to UV while not being used, being loaded beyond the recommended load (max weight per person 85kg) + luggage ,over inflation or excessive air pressure  or being dragging over a dry surface or incorrect/excessive loading.

Aqua Xtreme shall not be under any liability in respect of any defect arising from fair wear and willful damage or negligence.

Aqua Xtreme assumes no liability for consequential damages, anticipated or lost profits, incidental damages, loss of time, or other losses incurred by the Buyer or any third party in connection with the Goods

 

There are no warranties which extend beyond the description of the face hereof. Aqua Xtreme shall not be held liable for incidental and consequential damages.

 

This warranty is inclusive in lieu of all other warranties.
